Hi All,
How important is the location of the US embassy for getting the H1B visa stamping ? When applying for my H1B petition in April 2008, my lawyer had mentioned that I would be going to the US embassy in Germany for the H1B visa interview. I'm also aware that I could go to my home country for doing the same. However, does anyone know if I can go to Canada/Mexico, given that I have the visas to go to these countries ? I have a US H4 visa.

I received RFE that says" your application contained form I-693 in which the required TB skin test was not conducted. Please note there may be conflicting information on some published form I-693 instructions regarding when the chest X ray Report should be performed. It is required only when the TB skin test indicates a reaction equal to greater than 5 mm, or when the reason for why the TB skin test is medically inappropriate to perform has been annotated on theform I-693. Please submit a newly completed form I-693 indicating the results of the required skin test."
I did TB skin test in 2007 that came negative and it appears to me, civil surgeon did not updated results on I-693 form. After consulting with the doctor they filled up new I-693 from with 2007 test results and gave me in a sealed envelop. I need to know whether 2007 results will be acceptible to USCIS or do I need to do it gain before I submit response. Please advise.

New numbers are out on H-1B usage and the past week showed last week's substantial pickup was just noise. Only 800 visas were claimed against the 65,000 cap, half of last week's total and somewhat less than the typical weekly usage we've seen over the summer. 37,400 H-1Bs have been counted now. I'm moving my exhaustion projection date back a week. My target is based on a rolling four week usage average so variations from week to week are discounted. TSC 485 processing date says Aug 17,2007.
Does it mean, they reviewed almost all cases before Aug 16,2007?
My receipt date is Aug 13,2007. Notice date is Oct 10,2007.
So wondering whether they touched my case or still not?
Means, they reviewd all cases wherever the VISA dates were allocated/available. As you are from India, you have thousands of cases ahead of you.

Yes, you can apply for H-4 despite the fact that she has an H1 petition approved. It is difficult for me to comment on her H-4 rejection chances as I am not familiar with your cases, but generally if you are on valid H-1 status then you should not have problems.

Do you know how long it takes for the SWA order to be posted after a job order has been requested with the SWA?
Is it immediate or does it take some time for the SWA to process the job order and then post it?
Also do you know where we can see the job order after it has been posted? Is there a public site where we can see the jobs?

I am planning to travel via BA from DC to Bangalore and travel back from Bangalore to DC through Lufthansa.
I have my AP doc. I know Lufthansa is fine with an AP while I travel from Bangalore to DC visa Frankfurt.
Will I need a transit visa to travel through London to India (one-way)? I have a valid Indian passport and am on Advance Parole.

Yes something basic seems to be missing in our immigrant community. I want to repeat these are just 6 users who are very vocal and influencing thousands of people.
Sorry to say this, but it appears our worst enemies seem to be fellow immigrants, not anti-immigrants.
All I can say is someone has to be criminally negative minded, to oppose a campaign where money is not even being solicited. This culture of hate has to go and has no place in the USA.
This campaign along with the DREAM campaign was also supported by Murthy forum.
Murthy is one of the top immigration lawyers. It is a moderated forum, and the lawyers are personally aware of the content. They have supported us on previous Advocacy days.
As far as the question about law, I am no lawyer and will defer to admins. Core is in touch with many lawyers and I can assure you, they will pick up an action item, only if it has a very good chance of success.
Also Greg Syskind, one of the best lawyers in the country is on our advisory board, and core talks to USCIS, law makers regularly. So to claim this is not legally possible is just absurd.
On our home page we have the best minds on immigration listed, in our advisory board.
So you have all the above lawyers, lobbyists, core who are supporting this and 6 people with EAD think its not possible?

I believe same. Those minds are not only selfish but they are really really cruel, cunning and they don't deserve to be part of american dream.. All they care is their green card..rest of eligible people who are waiting to file 485 can have unknown waiting time for their chance of filing 485 and can live in the state of limbo.

No that's not the case, there are stringent reqmts for proof of Date of Birth. Passport is not one of them...
Please check other forums where this has been discussed..
